IN OUR MOBILE APPLICATION, BY SELECTING “GET STARTED” AND BY PROVIDING YOUR MOBILE NUMBER AND SELECTING “SEND OTP”, YOU SIGNIFY THAT YOU AGREE TO OUR TERMS OF SERVICE.
THESE TERMS OF SERVICE MAY BE AMENDED BY JYOTISHDEKHO AT ANY TIME IN OUR DISCRETION BY POSTING THE AMENDED TERMS ON OUR WEBSITE. Although portions of the Content may be viewed simply by visiting the JYOTISHDEKHO website, in order to access the personalized astrological zone and/or receive additional services from JYOTISHDEKHO (the "Paid Services"), You may need to register as a member of JYOTISHDEKHO to receive certain Paid Services. The Free Services and the Paid Services are referred to collectively in these Terms of Service as the "Services." In consideration for the Free or Paid Services, Member agrees to:
(1) provide certain current, complete, and accurate information about Member as prompted to do so by JYOTISHDEKHO and
(2) maintain and update this information as required to keep it current, complete and accurate. All information that We request and You provide on signing up, and all updates thereto, are referred to in these Terms of Service as "Registration Data." Many or Some of the Services and Content provided may be offered by third party suppliers time to time basis and not by JYOTISHDEKHO.
2. MEMBER ELIGIBILITY: The Services are available only to individuals who can form legally binding contracts under applicable law. Without limiting the foregoing, the Services are not permitted to be used by minors (which means, in most jurisdictions, those under the age of 18) or temporarily or indefinitely suspended JYOTISHDEKHO members. MEMBER REGISTRATION DATA: Upon registration, including Your provision of Registration Data such as mobile number and / or email address, You will receive a JYOTISHDEKHO identification such as OTP and / or password. You are entirely responsible if You do not maintain the confidentiality of Your JYOTISHDEKHO login credentials. You are responsible for all uses of Your account, whether or not actually or expressly authorized by you. You agree that Your account, phone number, EMAILID, and password / OTP used for JYOTISHDEKHO services may not be transferred or sold to another party. You agree to immediately notify JYOTISHDEKHO of any unauthorized use of Your account or any other breach of security known to You.
4. OUR ACCESS TO YOUR ACCOUNT: In order to ensure that JYOTISHDEKHO is able to provide high quality services, respond to customer needs, and comply with laws, You hereby consent to JYOTISHDEKHO employees and agents being able to access Your account and records on a case-by-case basis to investigate complaints or other allegations or suspected abuse.
5. MODIFICATION TO SERVICES; BREACH; TERMINATION: JYOTISHDEKHO may modify or discontinue (in whole or in part) the Services or Your account with us, with or without notice, for any reason without liability to You, any other user, or any third party. Without limiting the foregoing, We reserve the right to terminate Your account immediately (a) if We are unable to verify or authenticate Your Registration Data or other information provided by You, (b) if We believe that Your actions may cause legal liability for You, JYOTISHDEKHO, or all or some of Our other users, or (c) if We believe You have (i) provided us with false or misleading Registration Data or other information, (ii) interfered with other users or the administration of the Services, or (iii) violated these Terms of Service or our Privacy Policy.

PRIVACY POLICY: Privacy is very important to us, and as such, Our Privacy Policy, as it may be updated from time to time, available on the Website, is incorporated into these Terms of Service by this reference. We may amend Our Privacy Policy from time to time pursuant to the terms for amending this Terms of Service (as described in the Preamble above).
7. PRICING POLICY
User shall understand and agree that Pricing of Products and Services offered by the Website or Mobile application of Jyotish Dekho are highly dynamic and may vary based on Demand and Supply and Market situation. Website or Mobile application does not guarantee any standard pricing for using Jyotish Dekho Products and / or Services to any users for any time period or through any service provider though any form.
8. REFUND / CANCELLATION POLICY:
• User agrees to provide current, complete, and accurate information about him/herself whenever Jyotish Dekho seeks information for Horoscope Consulting Services
• To maintain and update the above information as required and submitted by you with the view to maintain the accuracy of the information being current and complete.
• The refunds, if any, shall be processed only after deduction of the transaction charges levied by the Bank and/or the Payment Gateway, to & fro cost of the shipping and/or courier charges (With regard to purchase of a product listed on the Website), customs duty (if levied) and/or any other charges that may have been incurred by the Website during processing and/or delivering the service, as applicable.
• User and / or Astrologer understands that he / she shall use the JYOTISHDEKHO consulting services via mobile app with Safe, Secure, Good quality, Strong signal and stable internet connection. It is the responsibility of Users and / or Astrologer to ensure that they are utilizing the services of JYOTISHDEKHO with good quality Phone and Internet Connection. JYOTISHDEKHO is in no way responsible for the quality or disruption of the chat or audio / video call due to poor quality cellular, broadband, fiber wi-fi network coverage and internet data at the User as well as Astrologer side.
• No refund shall be entertained after the Wallet Balance utilized for chat, audio call or video call services. No refund shall be entertained for the Chat, Audio Call or Video Call which are disconnected abruptly due to Internet Issues / Signal Issues at User and / or Astrologer side. JYOTISHDEKHO does not take responsibility for the chat or audio call or video call which are interrupted / disconnected / non attention by user or Astrologer during the consultation and No refund will be entertained.
• In case the Website or Payment gateway’s webpage, that is linked to the Website, is experiencing any server related issues like ‘slow down’ or ‘failure’ or ‘session timeout’, the User shall, before initiating the second payment, check whether his/her Bank Account has been debited or not and accordingly resort to one of the following options:
• However even after the above precaution against the same order, the duplicate payment may be refunded after deducting any costs to JYOTISH DEKHO that was linked with the transaction upon the request from the user genuinely.
• If there are orders that the Website is unable to accept and must cancel, the Website at its sole discretion, reserves the right to refuse or cancel any order for any reason whatsoever. Some situations may result in the order being cancelled and include, without limitation, non-availability of the service, inaccuracy, error in pricing information or other problems as identified. If the User’s order is cancelled after charges being paid against the said service, the said amount paid for booking shall be refunded.
• No refund shall be processed on the services / orders of any appointments or reports under any circumstances if the order has reached the Astrologer and Astrologer starts his / her work on the service, reports etc.,. The risk and liability of placing order in a haste and careless manner totally lies with the User and the Website is not responsible for any refund once the processing stage has started.
• No refund shall be processed once the Order has been placed and executed. However, if the User intends to cancel a successfully placed order before execution, or use of consulting services of JYOTISH DEKHO, the User is required to contact us within 1 (one) hour of making the payment to admin@jyotishdekho.in / gemastroworld@gmail.com , where after it is totally at the discretion of the Website whether to issue refund.
• Any technical delay or glitch reported in the JYOTISH DEKHO Mobile App or Website during the processing of the request which includes generating reports by the service provider i.e. Astrologer, shall not be eligible for claiming refund. The User agrees that the timelines are approximate and all essentials steps would be taken to adhere to the timelines as displayed.
• No refund shall be processed for the reason that in-correct information or data has been provided by website users. The User agrees to be careful while providing any information to the Website / to the astrologer and must re-check the information while providing to Jyotish Dekho.
• No refund shall be processed for return of any delivered services / damaged product. The User undertakes and agrees that by ordering any product / services / reports as displayed on the Website, the Registered User shall be fully responsible for any damaged caused to the product, post its delivery. For orders made via “Cash on Delivery” method of payment, the User shall be charged for the cost of the product as displayed by the Website and the shipping/custom/courier charges as applicable, if the product is returned in original condition without any usage, stains, modification, damages etc.,
• User / member / astrologer agree that the display picture for the products listed for purchase by the User are for reference purpose only and the Website will try but cannot guarantee to deliver the product ordered in an as-is condition as displayed on the Website. The User is advised to exercise discretion in such case and no refund shall be issued on such grounds.
• No refund shall be processed for providing a wrong contact number for the purpose of availing the “Call with Astrologer” feature. The User once opted for this feature is advised to keep the Contact Number in full coverage area with good quality mobile signal and internet signal and must answer the call when received. No refund shall be processed for any call which gets connected.
• Refund for any other reasons arising from time to time that are not listed above would be at the sole discretion of Jyotish Dekho and user agrees to co-operate with Jyotish Dekho. By using this website and mobile application user agrees that he/she consistently updates him / herself about the delivery, Cancellation and Refund policy.
• The services offered and the products sold are strictly not meant to replace, including but not limited to, any form of technical, philosophical, emotional or medical treatment. The Website holds no responsibility or liability whatsoever about the quality, reality or reliability of the astrological effects on the human physiology, by the goods and / or services represented and sold on the Website. The placing of order for buying such products or taking the services is solely on the discretion and will of the User and the Website does not have any responsibility upon the products sold. The User is advised to exercise discretion in such case and no refund shall be issued on such grounds.
• Any eligible refunds will be made only after deducting the transaction charges levied by the bank and / or the payment gateway, or any other charges that may have been borne by JYOTISHDEKHO in processing and / or delivering the service, as applicable.
9. MEMBER BEHAVIOR AND RESTRICTIONS; COMPLIANCE WITH LAWS: Your right to use the Services is personal to You. You represent that You are an individual and that You are not a corporation or other business entity. You agree not to resell or make any commercial use of the JYOTISHDEKHO Services without the express written consent of JYOTISHDEKHO. You are solely responsible for the contents of Your transmissions through Our Website. Your use of the Services is subject to all applicable local, state, national and international laws and regulations. You agree:
(a) to comply with all Indian laws regarding the transmission of technical data exported from the India through the Service;
(b) not to use the Website or the Services for illegal purposes;

(f) Prohibition on Using Website Content for Training AI Models:

(B) IN PARTICULAR, BUT NOT BY WAY OF LIMITATION, JYOTISHDEKHO MAY DELETE E-MAIL OR OTHER ACCOUNTS OR THE INFORMATION THEREIN IF THE ACCOUNT IS INACTIVE FOR MORE THAN NINETY (90) DAYS;
(C) USE OF THE SERVICES IS AT YOUR SOLE RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR MOBILE CELL PHONE AND / OR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF JYOTISH DEKHO APPLICATION, SUCH MATERIAL AND/OR DATA;
(D) THE SERVICES ARE PROVIDED FOR ENTERTAINMENT PURPOSES ONLY AND JYOTISHDEKHO, ON BEHALF OF ITSELF AND ITS SUPPLIERS, DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT AND IT MAKES NO WARRANTY OR REPRESENTATION REGARDING THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF CONTENT OR SERVICES, THE ACCURACY OR RELIABILITY OF ANY CONTENT OBTAINED THROUGH THE SERVICES, ANY GOODS OR SERVICES PURCHASED OR OBTAINED THROUGH JYOTISHDEKHO'S WEBSITE, OR ANY TRANSACTIONS ENTERED INTO THROUGH JYOTISHDEKHO'S SITE, AND MAKES NO WARRANTY THAT THE SERVICES WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, TIMELY, SECURE OR ERROR FREE. (C) LOSS OF, UNAUTHORIZED ACCESS TO, OR ALTERATION OF, A USER'S TRANSMISSIONS OR DATA.
THE LIABILITY OF JYOTISHDEKHO AND ITS SUPPLIERS TO YOU OR ANY THIRD PARTIES ARISING OUT OF OR IN CONNECTION WITH OUR WEBSITE, THE SERVICES, OUR PRIVACY POLICY, OR THESE TERMS OF SERVICE (HOWEVER ARISING, INCLUDING NEGLIGENCE) IS LIMITED ONLY TO THE AMOUNT OF FEES YOU PAID TO US.

PROPRIETARY RIGHTS TO CONTENT: You acknowledge that the Content, including but not limited to text, software, music, sound, photographs, video, graphics or other material contained in either sponsor advertisements or distributed via email, text or whatsapp / social media messages, commercially produced information presented to Member by JYOTISHDEKHO, its suppliers, and/or advertisers, is protected by copyrights, trademarks, service marks, patents and/or other proprietary rights and laws. You are not permitted to copy, use, reproduce, distribute, perform, display, or create derivative works from the Content unless expressly authorized by JYOTISHDEKHO, its suppliers, or advertisers.
12. NOTICES. Except as otherwise stated in these Terms of Service, all notices to a party shall be in writing and shall be made either via email or snail mail. Notice shall be deemed given 1 week after an email is sent, or 15 days after receipt of Registered post via India Post, to Member at the address provided by Member in the Registration Data and to JYOTISHDEKHO at the address set forth below: admin [at] jyotishdekho [dot] in / gemastroworld [at] gmail [dot] com ; Postal address: 60, Ph-2, Thankamnagar, Erode, TN
13. ARBITRATION; INJUNCTIVE RELIEF. Any dispute, controversy, or claim arising out of, relating to, or in connection with this Agreement shall be settled by binding arbitration in accordance with the commercial arbitration rules in the Indian Law. The arbitration shall be conducted by a single arbitrator, selected in accordance with the rules in the Indian Law, and judgment on the arbitration award may be entered in any court having jurisdiction thereof. Notwithstanding the foregoing, either party has the right to seek any interim or preliminary relief from a court of competent jurisdiction in Erode, TN in order to protect the rights of such party pending the completion of any arbitration hereunder, and both parties agree to submit to the exclusive jurisdiction of the courts of India and venue in Erode, Tamil Nadu for any such proceeding. If either party files an action contrary to this provision, the other party may recover attorneys' fees and other incidental costs.
14. GENERAL PROVISIONS:
